		<description><![CDATA[The Cecil County government is seeking court “sanctions” against Del. Michael Smigiel and repayment of nearly $40,000 the county spent to defend itself against a losing lawsuit by Smigiel challenging County Executive Tari Moore’s post-election shift from Republican to “unaffiliated.” A judge ruled several weeks ago that Smigiel’s case had “no support whatsoever” in the law and that the Elkton lawyer hadn’t even bothered to file responding briefs in the case. It is Smigiel’s failure to take any action in his case after the initial filing of a complaint last January that is at the heart of the motion filed several days ago by Jason Allison, the Cecil County Attorney. The motion details how Smigiel repeatedly did “nothing” to bolster or argue his case and that he failed to respond to repeated legal warnings that his case was fundamentally deficient. Consequently, Allison contends Smigiel acted in “bad faith” and the Circuit Court should impose “sanctions” and require Smigiel to reimburse the county for its legal expenses in the case. Smigiel filed the case on behalf of Chris Zeauskas, chair of the county’s Republican Central Committee, but the county is not seeking any sanctions or reimbursements from Zeauskas. 		<description><![CDATA[A Circuit Court judge has thrown out a lawsuit by Del. Michael Smigiel challenging the appointment of Joyce Bowlsbey to the Cecil County Council, ruling there was “no support whatsoever” in the law for Smigiel’s claims and noting that the delegate hadn’t even bothered to respond to county legal arguments in the case although he was given an extended period of time to do so. Circuit Court Judge Thomas E. Marshall&#8211; a visiting judge who decided the case after local Cecil County judges recused themselves from hearing it&#8211; dismissed Smigiel’s lawsuit, saying that he failed to assert proper “standing” to sue and that his arguments misconstrued the “plain language” of the county Charter dealing with appointments and vacancies on the Council. Tari Moore switched her political party registration from Republican to “unaffiliated” shortly before resigning her seat on the Board of Commissioners/County Council to become Cecil County’s first County Executive last December. 		<description><![CDATA[A Cecil Times Special Report Cecil County Commissioners this week reviewed revisions to the county’s animal law proposed by a small remnant of a two-year old task force that has all but disbanded. A Cecil Times review of documents shows that an unappointed activist given a seat at the bargaining table Tuesday is a donor to a political action committee seeking to influence state and local animal laws, while Commissioners’ board President James Mullin (R-1) orchestrated the exclusion of the local SPCA from previous discussions of the proposal. In some “only in Cecil County” moments, Commissioner Robert Hodge (R-5) sought to make sure that any new ordinance would not bar his recent acquisition of two female zebras as pets on his farm. And Commissioner Mullin suggested that the county demand that all contractors, including road paving firms, disclose personal financial information before being allowed to bid on county contracts— in a ploy to justify attempts to delve into the SPCA’s finances beyond their publicly available reports to the IRS.
