A CECIL TIMES SPECIAL REPORT Karl.H. Fockler, a candidate for Cecil County State’s Attorney in the June Republican primary, is under court-ordered garnishment of his salary as a prosecutor due to court judgements for millions of dollars in unpaid debts. If elected state’s attorney, he would get a major pay boost and would be in charge of managing a more than $2.4 million annual budget, virtually all of which is provided directly by county taxpayers. Multiple Circuit Court judgements, in Cecil County and other jurisdictions, total at least $1.8 million for unpaid debts against Fockler while another judgment against Karl Fockler and his wife, Suzanne, amounts to $473,014, bringing the total to over $2.3 million. Several other judgements or liens, including for unpaid state and federal taxes, were also filed but were subsequently listed as “satisfied,” or paid off, according to state court records. In addition, Karl Fockler and his brother, Edwin B. Fockler IV, an assistant public defender who is a candidate for a Cecil County Circuit Court seat in the June Republican primary election, recently insisted at a GOP candidates’ forum that their familial relationship would not be an ethics or conflict of interest issue if both were […]

The long-stalled sale of most Cecil County water and sewage treatment plants to the private Artesian firm has received staff recommendations to the state Public Service Commission to approve the sale. The sale, originally approved by the Cecil County commissioners nearly three years ago, was blocked by litigation initiated by the Appleton Regional Community Alliance (ARCA), an anti-growth group based in the northeastern area of the county adjacent to the Delaware state line. However, the state’s highest court, the Maryland Court of Appeals, ruled recently in favor of the county to permit the sale. [See previous Cecil Times report here: https://ceciltimes.com/2011/06/court-of-appeals-rules-cecil-county-can-sell-watersewer-plants-to-artesian-court-orders-arca-to-pay-some-county-legal-fees/ But there is still another hurdle for the proposed sale. It must be approved by the state Public Service Commission. That panel is scheduled to hold a hearing on the issue on Wednesday in Baltimore. [UPDATE: A last-minute bid by some county commissioners to delay PSC action was filed in a letter from Del. Michael Smigiel (R-36) to the state panel. In addition, a majority of the commissioners decided Tuesday to fire their long-time attorney, Lawrence Haislip, from representing the county in the sale to Artesian, according to Artesian officials who were notified on Tuesday.] [UPDATE: In a brief […]

The Cecil County Commissioners voted Tuesday to terminate a contract with Artesian to operate several county-owned water and sewer plants to save money while both sides await completion of a long-stalled sale of the county plants to the private Artesian operation. But a county official warned that there could still be foot-dragging that could delay the sale further. The long running saga of legal action against the sale to Artesian finally came to an end a week ago when the state Court of Appeals ruled, 4-3, that the county had the legal right to sell the facilities to Artesian. The sale was initially approved in 2008 but lawsuits by the Appleton Regional Community Alliance (ARCA) dragged on for nearly three years. In the interim, the county has been paying Artesian under a separate “services” contract to operate some of the facilities, at a cost of over $600,000 so far, according to county budget officials. The ARCA lawsuit also cost Cecil County over $203,000 in legal bills. [See previous Cecil Times report here: https://ceciltimes.com/2011/06/arca-lawsuits-cost-county-citizens-up-to-1million-and-counting-on-artesian-sale/ County Public Works Director Scott Flanigan reiterated his view that the county could hire independent contractors to provide operations assistance at a cheaper cost while waiting for […]
