		<description><![CDATA[The Maryland Public Service Commission has approved the sale of most Cecil County water and sewage treatment plants to the private Artesian firm, rejecting arguments by the Appleton Regional Community Alliance (ARCA) that has battled against the sale for over three years. In an order dated 8/31/11, the PSC ruled that Artesian had “the financial, technical, and managerial resources and qualifications to operate and maintain the water system in Elkton West and in the Elkton West Extended area in Cecil County, Maryland.” Furthermore, Artesian demonstrated, with a detailed analysis by the Maryland Department of the Environment, that the company has significant water resources to more than meet the needs of the area for which the county granted Artesian a franchise, the PSC said. “In addition to its financial, technical and managerial fitness, the Applicants have demonstrated the ability to assure the availability of adequate and reliable water supplies for the foreseeable future from a variety of sources, including Susquehanna River sources that are currently unavailable to the County,” the PSC stated. And the regulatory panel also rejected claims by ARCA that the sale would impair the county’s ability to comply with state and federal anti-pollution mandates for its other operations. 		<description><![CDATA[The Cecil County Commissioners voted, 3-2, Tuesday to hire a new lawyer, with close ties to Del. Michael Smigiel (R-36), to review the 2008 contract to sell county water and sewer plants to the private Artesian firm. The commissioners set no dollar limit on the fees the new lawyer can receive. The move was initiated by Commissioner Diana Broomell (R-4), a staunch opponent of the sale of most county water and sewer plants to Artesian. Voting with her were her usual compadres, Commissioner Board President James Mullin (R-1) and Commissioner Michael Dunn (R-3) Voting no, as usual, were Commissioners Robert Hodge (R-5) and Tari Moore (R-2). Hodge and Moore said the action was a waste of taxpayer funds. The county has already spent over $203,000 in legal fees to defend the sale against a lawsuit by the Appleton Regional Community Alliance (ARCA) that was rejected by the state’s highest court. Broomell and Mullin said their ultimate goal was to try to “renegotiate” the sewage treatment portion of the contract. 		<description><![CDATA[Cecil County Commissioners backed down, after a battle royale at their Tuesday morning public worksession and a more than three-hour secret meeting, from a bid by Commissioner Diana Broomell (R-4) to demand the firing of the entire Miles &#038; Stockbridge law firm, and not just an individual attorney, from representing the county in all aspects of the sale of county water and sewer plants to the private Artesian firm. But it could be a short-lived truce in the battle. After several weeks of closed-door discussions, decisions and actions, the whole brouhaha is expected to finally be brought out into a public discussion at the commissioners’ next worksession. At stake are the potentially huge legal bills that could be incurred by taxpayers to bring in another law firm unfamiliar with the complex Artesian case if the commissioners go along with Broomell’s demand. And such a step could also risk a costly legal push-back against the county from Artesian. Two Artesian executives witnessed the flareup among the Commissioners on Tuesday morning.
